The Department reiterated its orders dated 11-07-2000 in connection with forcible allotment of Staff quarters in the Postal colony to SPMS of Town Sub Offices.
The NUPE Group C brought several cases to the notice of the Directorate quoting the orders dated 11-07-2000.The latest being about the SPOs,Pali Marwar postal Division in Rajastan cirle.This clarification issued to the response to our reference. If circles are not following the Directions of the Department who will be held resposible for the mental agony of oficials who faced huge recoveries and expenses to the court cases?

I am directed to intimate that instances have come to the notice of this Directorate that the officials posted as Sub-Postmasters in Town Sub offices are being forced to occupy the staff quarters in the Postal colony without applying for the same.
2. In this connection Instructions issued by this office by this directorate vide letter No 7-6/99-Bldg (copy enclosed) dated 10-11-200 on the subject mentioned above may kindly be referred to. As per the extant orders no Government accommodation can be thrust upon any Government employee against hs willingness and in the absence of a written request for allotment of a quarter from the employee. However it is mandatory for the employee to occupy the post attached rent free accommodation wherever available. In such cases no HRA can be drawn in favor of the employee even if he is unable to occupy the rent free quarter.
3. It is therefore requested that the instructions/guidelines on the subject may kindly be followed strictly.

Sub:-Allotment of Staff quarters
A reference has been received from the Kerala circle in which a clarification has been sought from this office as to whether the department al quarters if any vacant should be allotted to Senior most eligible officials immediately and if they refused to take allotment the HRA is to be deducted from the salary of the officials concerned. The circle has made reference to the Supreme Court in civil Appeal No 19993 filed by Central plantation research Institute Kasargode.
The said reference of the Kerala circle received in their letter No Bldg/12-1/94/VIII/Rlgs dated 9-8-1999 has been considered.
The circle has not enclosed the full text of the judgment of the Supreme Court. Infact
No part of the Judgment has been sent to this office by the circle. Such incomplete references should not be made to this office.
The Rules pertaining to allotment of Govt Quarters are given in the FRSR.They apply mutatis-mutandis tot eh quarters in the Postal pool under the administrative control of Department of Posts except where this Department has issued its own separate ruling to govern the allotment of staff quarters and conditions thereof. No Government accommodation be thrusted upon any Govt employee against has will and in absence of a written request for allotment of a quarter from the employee. However it is mandatory for the employee to occupy the attached rent free accommodation wherever available .In such cases no HRA can be drawn in favor of the employee if he refuses to occupy the rent free quarter.
