I humbly submit that I was retired from service on Superannuation on 30.6.2018 after noon. All my pension benefits are calculated and sanctioned on the basis of my last pay drawn. The increment due on 1.7.2018 was not taken into account for the purpose of Pensionary benefits. Consequently I am put to heavy financial loss.
In this context I submit that after VI Pay Commission Central Government has fixed 1st July as the date of increment for all employees amending Rule 10 of the CCS (Revised Pay) Rules 2008. Increment is granted to any Government Servant after completing one full year of service. I have completed full one year in service from 1-7-2017 to 30.6. 2018 and thus became eligible for an increment from 1.7.2018.
It is submitted that an increment is an amount by which an employee’s salary automatically increases after a period of 1 year. In other words an increment has to be granted to the Government Servant if he renders one years service. Whoever that completes one year service is entitled for an increment at the prescribed rate, on the last day after noon. However it is payable from 1.7.2018.
If a Government servant renders 1 year service in a post on time scale he is entitled for annual increment at the prescribed rate as per the provisions contained in FR-26. It is immaterial whether the Government servant was on duty or retired.
Government of Tamilnadu issued Orders to grant notional increment to Government servants who retired on superannuation on the preceding day of increment due date purely for the purpose of Pensionary benefits not for any other purpose through GO MS No. 311 dated 31.12.2014. It is implemented for all the State Government employees.
Some other employees of the State and Central Government approached the Hon’ble High Court Madras to extend the above benefit to them also through the following Writ Petitions. The Hon’ble High Court Madras gave Judgments in their favour. In other words the respondents were directed to grant notional increment on completion of one year service for the purpose of Pensionary benefits only. I am also similarly placed and entitled for the benefit of notional increment to be counted for the purpose of Pensionary benefits.

2. P.Ayyamperumal Vs Union of India Rep. by Chairman CBEC New Delhi and Department of Personnel and Training New Delhi. WP 15732 of 2017. Judgement dated 15.9.2017.
It is to further inform that the SLP No. 22283/2018 filed by Union of India against the Order dt 15.9.2017 in WP No. 15732/2017 has been dismissed by Honble Supreme Court vide Order dt 23.7.2018. The case has thus attained finality and the Order of the Madras High Court has to be implemented.
From the foregoing submission it is clear that I am eligible for notional increment due on 1.7.2018 which shall count for Pensionary benefits, as I have completed one year service by 30.6.2018.
In view of the above facts and circumstances I request you to kindly consider the submissions made by me, in the light of the above mentioned GO MS, High Court Judgments and Order of the Hon’ble Supreme Court in the SLP and issue appropriate orders to grant notional increment due on 1.7.2018 with further direction to count it for all pensionary benefits for which act of your kindness I shall be thankful to you sir.

All the divisional secretaries are requested to guide the officials who retired on 30/6/2018 i.e before the day of increment to represent for grant of notional increment, new DA from July and accordingly pensionary benefits on below two formats to the respective CPMG s. I humbly submit that I was retired from service on attaining the age of superannuation on 30.6.2018 afternoon.
I further submit that Pension and Pension benefits are payable to me taking into account the 2% DA granted with effect from 1.7.2018, as per rules and law laid down by various Courts on the subject.
So far no action has been taken to sanction the Pension benefits taking the DA granted from 17 2018 into account.
I therefore request you to kindly issue appropriate orders to the concerned in this regard to draw and pay Pension benefits taking into account the dearness allowance granted/due from 1.7.2018 for which act of your kindness I shall be thankful to you sir.
